CartCycle Terms of Service

These Terms describe the rules for using CartCycle, a household grocery ledger and planning service. They are written for the controlled beta and must receive owner and qualified legal review before launch.

Before launch: confirm these items
This visible checklist keeps unresolved owner and legal decisions from being mistaken for settled terms.
  • Effective date, legal entity name, and the legal/business contact details.
  • Governing law, venue, dispute process, arbitration choice, and jurisdiction-specific provisions.
  • Subscription refunds, trial treatment, cancellation timing, price changes, and downgrade effects.
  • Actual hosted billing behavior for CartCycle Plus and the $4.99/month family add-on target.
  • Founding beta eligibility rules and the lifetime Plus benefit for accepted eligible testers.
  • Whether and how marketing-email consent is collected and stored separately from account acceptance.
  • Children under 13 and any child-data safeguards required if CartCycle knowingly collects that information.
  • Liability limits, indemnification language, and any other qualified legal review required for the user’s jurisdiction.
1. Acceptance of these Terms
By creating an account or using CartCycle, you agree to these Terms of Service and acknowledge the Privacy Policy. If you do not agree, do not create an account or use the service. The Privacy Notice explains CartCycle's current data practices and should be read together with these Terms.
2. Eligibility and children’s privacy
CartCycle is intended for people who are at least 18 years old and able to enter a binding agreement. Do not create an account for another person without authority to do so. CartCycle is not intended for independent use by children under 13.
  • If CartCycle knowingly collects personal information from a child under 13, the owner must complete a separate children’s-privacy review and put any required parental notice, consent, deletion, and data-minimization process in place before that collection is allowed.
  • The child-data posture and any age-verification or parental-consent process remain [OWNER / LEGAL REVIEW REQUIRED].
3. Account responsibilities
Provide accurate account information and keep it current. Protect your password and other account-security details, use a unique password, and tell CartCycle promptly if you suspect unauthorized access. You are responsible for activity under your account, subject to rights that cannot legally be waived.
4. Household accounts and visibility
A household owner can invite or remove a household member through the controls CartCycle provides. Invited and active members may see the shared grocery, spending, prediction, and shopping-plan information that the product exposes for that household.
  • By joining a shared household, members understand that certain purchase history, shopping plans, spending information, recommendations, and household activity may be visible to other authorized household members.
  • The Privacy Notice describes the current boundary: household-scoped records can be visible to active members, while records without a household scope remain account-scoped.
  • Household owners and members are responsible for inviting only people they trust and for removing access when it is no longer appropriate.
5. Receipt uploads and grocery records
You may upload receipts and provide grocery records only when you lawfully possess and may share them. To provide CartCycle, we may process receipt-derived and related grocery information such as product names, prices, stores, quantities, dates, categories, and household context.
  • Receipt images are processed transiently under the current Privacy Notice and are not stored as receipt images. Extracted and reviewed fields may be retained as grocery and planning records.
  • You are responsible for reviewing extracted receipt fields and correcting or discarding them before relying on them.
6. Cart predictions are estimates
CartCycle may estimate shopping needs from purchase history, receipt information, household activity, saved preferences, and other information provided through the service. Predictions can incorrectly suggest, omit, time, or quantify products. They are estimates, not guarantees, professional advice, or a promise that a product is needed or available.
  • Historical and predicted product, price, quantity, timing, and spending information may be stale, incomplete, or inaccurate.
  • Displayed prices are not guaranteed retailer prices and should be checked before purchase decisions.
7. Predict → Review → Shop: your approval is required
CartCycle prepares predictions and shopping plans for you to review. You remain responsible for reviewing the proposed items, quantities, dates, fulfillment choices, and costs before acting on them. Nothing in CartCycle automatically purchases products or authorizes a purchase on your behalf.
  • CartCycle does not place grocery orders or complete retailer checkout.
  • A user must explicitly choose the next step after reviewing a plan or handoff.
  • You remain responsible for the final purchasing decision and for checking the retailer’s current information.
8. Third-party retailers and retailer handoffs
CartCycle may provide links or tools that allow users to continue shopping with third-party retailers. CartCycle does not control retailer inventory, pricing, substitutions, fees, delivery availability, fulfillment, or refund policies. Unless expressly stated otherwise, CartCycle is not the seller of products purchased through a third-party retailer.
  • CartCycle prepares or facilitates a handoff only; it does not place grocery orders.
  • CartCycle does not use retailer credentials, receive retailer credentials, or connect retailer accounts unless the product explicitly changes and these Terms are updated.
  • Any retailer purchase is between you and the retailer, under that retailer’s terms and policies.
9. Feedback and service improvement
Actions such as Add, Not yet, Don’t suggest this, completed purchases, receipt uploads, confirmations, corrections, and other history you provide may be used to operate CartCycle, provide your requested features, protect the service, and improve predictions and the product. These uses must remain aligned with the Privacy Notice; CartCycle will update both documents before launch if the approved data-use explanation becomes broader.
  • You retain ownership of content you provide, subject to the limited service license in these Terms.
  • Feedback you choose to provide may be used to improve CartCycle without creating a promise of compensation unless a separate written beta offer says otherwise.
10. CartCycle Plus subscriptions
CartCycle Plus is currently presented as $9.99 per month for the primary account. It is intended to bill monthly and automatically renew until canceled. The current app checkout is configured with a 14-day trial, but trial, refund, and cancellation treatment must be confirmed against the hosted billing flow and reviewed before launch.
  • The purchase surface says: “Automatically renews monthly until canceled” and “Cancel anytime before your next renewal date.” Use the hosted customer portal to manage or cancel billing when it is available.
  • A second household user is intended to be a separate $4.99/month family-plan add-on. The app’s current billing source still uses $5.00/500 cents, so the $4.99 amount is a launch target pending owner confirmation of the hosted catalog and legacy handling; it must not be treated as an effective charge until reconciled.
  • Refund availability, trial conversion, cancellation timing, price-change notice, and what remains available after a household downgrades are [OWNER / LEGAL REVIEW REQUIRED].
  • Existing $5.00 family subscriptions must be handled compatibly and must not be silently invalidated if the add-on price changes.
11. Founding beta program
The controlled founding beta is experimental. Predictions may be wrong or incomplete, features may change or be removed, and data loss or service interruptions may occur. Do not rely on CartCycle for guaranteed purchasing decisions; review every shopping plan and remain responsible for your choices.
  • Accepted founding beta testers receive lifetime CartCycle Plus access at no cost, subject to the actual eligibility and acceptance rules confirmed by the owner before launch.
  • No additional tester payment, prize, or compensation is promised unless it is defined in a separate confirmed offer.
  • Feedback submitted during the beta may be used to operate and improve CartCycle.
12. Acceptable use
Use CartCycle lawfully and only for its intended purpose. Do not abuse, scrape, reverse engineer, probe, or disrupt the service; attack its security; upload fraudulent or unlawfully obtained receipts; automate access in a way that burdens or bypasses safeguards; impersonate another person; interfere with another household; or use CartCycle for unlawful, harmful, or deceptive activity.
13. Intellectual property and your content
CartCycle owns or licenses its software, service design, branding, and other product materials. You retain ownership of content you provide. You grant CartCycle a limited, non-exclusive right to host, process, reproduce, adapt, and display that content only as reasonably needed to operate, improve, secure, and protect the service, consistent with the Privacy Notice.
14. Suspension, termination, and account closure
CartCycle may suspend or terminate access when reasonably necessary to address abuse, security, fraud, unlawful use, payment issues, a breach of these Terms, or a material risk to the service or another person. You may stop using CartCycle and close your account through the available account controls. Account deletion and data handling are described in the Privacy Notice.
  • Where appropriate, CartCycle may provide notice and an opportunity to resolve an issue, but it may act immediately when safety, security, fraud, or legal concerns require it.
  • Termination does not remove obligations or rights that should reasonably continue, including payment obligations already incurred and intellectual-property or dispute provisions.
15. Service changes and availability
CartCycle may change, pause, remove, or discontinue features, plans, pricing, and availability. We may also change the product to improve safety, reliability, privacy, or the planning experience. We do not guarantee uninterrupted availability or preservation of every feature or record.
16. Disclaimers
To the maximum extent permitted by law, CartCycle is provided as available and without guarantees that it will be uninterrupted, error-free, secure, current, complete, or accurate. CartCycle does not guarantee prediction accuracy, retailer inventory or pricing, product availability, delivery, fulfillment, refunds, or purchasing outcomes. You should use independent judgment and review information before acting.
  • Nothing in CartCycle is legal, financial, medical, nutritional, or other professional advice.
  • The scope and wording of these disclaimers require qualified legal review for the jurisdictions where CartCycle operates.
17. Limitation of liability
The liability limits, exclusions, and damage categories for CartCycle are [TO BE DRAFTED AND CONFIRMED BY QUALIFIED LEGAL COUNSEL]. Any limit will apply only to the extent permitted by applicable law and will not waive rights or liabilities that cannot legally be waived.
18. Indemnification
To the extent permitted by applicable law, a user may be responsible for claims, losses, liabilities, and reasonable costs arising from the user’s unlawful use of CartCycle, fraudulent receipts, misuse of a household or account, violation of these Terms, or infringement of another person’s rights. 19. Governing law and disputes
Governing law, exclusive or non-exclusive venue, dispute process, arbitration choice, class-action treatment, and related jurisdiction-specific provisions are [OWNER / LEGAL REVIEW REQUIRED]. No state, country, court, venue, or arbitration process is being selected by this draft.
20. Changes to these Terms
CartCycle may update these Terms as the service changes or as legal review requires. For material changes, CartCycle will provide notice through a reasonable channel, such as an in-product notice or email to the account address, and will update the effective date. Continued use after the updated Terms take effect means you accept them where permitted by law; if you do not agree, stop using the service and close your account.
